Legal aspects of mining in Serbia
The new Mining Law of 2015 significantly improves the legal framework for exploration and mining investors. Dr Milan Parivodić participated in drafting the key provisions that improve the position of investors. These changes resulted in tripling the interest in investing in Serbia within a year after its enaction.
Key improvements add to 1) increased legal certainty and 2) reduce arbitrary powers of the state. Exploration terms are significantly extended. An investor who invests in exploration is guaranteed to receive exploitation rights if the legal requirements are met. Expropriation of surface land ownership is permitted for private mining for the first time. The new Mining Law is actually the first mining investment law in Serbia.
